Drivers Watch Out: Distracted Pedestrians Can Get You Sued

On my way to the law office in Sarasota today I was sitting traffic near an elementary school. With six lanes of traffic stopped a red light, I saw a young lady intently focused on her iPhone making her way between, the stopped cars to cross the street.

Just as the light turned green and drivers began to take their foot off their brake pedals two small children only visible by the tops of their heads just above the hood of the adjacent car followed the young lady.

This woman was still completely focused on her iPhone unaware her small children were suddenly in great danger. Fortunately by some stroke of luck the other drivers spotted the kids and they made it across Fruitville safely. This was nearly a tragedy that could have ended the lives of two young kids, a wrongful death law suit and many lives ruined, because a pedestrian was more worried about answering tweets or emails than paying attention to their situation and their children. With a tough economy, demanding work schedules and an always wired society, it’s easy to get caught up in staying in touch with work for fear of losing your job. There are worse things to lose than a few minutes between texts.

As drivers on Florida’s roads we will all have to be vigilant and always on the look out for anything. Simple actions like taking that second look in the mirror before changing lanes, checking both ways in the intersection after the light turns green for red-light-runners, giving the guy in front of you a little more room can mean the difference between a perfectly good day, or a deadly car crash. Distracted and irresponsible people are never going to go away. But being a little extra careful while driving can save both lives and the terrible experience of being sued because another person’s negligence caused a serious accident.

And if your out their taking taking your kids to school in traffic a little advice. Turn off the iPhone, cross only at marked cross walks, and if nothing, else pay attention to your children and the road!
